Preg, O’Donnell & Gillett Member Lori O’Tool and Of Counsel attorney David Chawes achieved dismissal of Washington Product Liability Act claims against their client, a large construction equipment manufacturer. Plaintiffs had alleged severe injury from one of the client’s allegedly defective products in a complex multi-party lawsuit in Pierce County. A Motion for Summary Judgment was filed on behalf of Preg, O’Donnell & Gillett’s client asserting that its affirmative defenses under the Product Liability Act of rebranding by the product distributor, expiration of the product’s useful safe life, and substantial modification by the product purchaser warranted dismissal. Plaintiffs agreed to voluntarily dismiss the product manufacturer from the lawsuit prior to the hearing of the summary judgment motion, ending the client’s involvement in this complex case.
